Article 32: Contempt of court by the press

ผู้ใดเป็นผู้ประพันธ์ บรรณาธิการ หรือผู้พิมพ์โฆษณาซึ่งหนังสือพิมพ์ หรือสิ่งพิมพ์อันออกโฆษณาต่อประชาชน ไม่ว่าบุคคลเหล่านั้นจะได้รู้ถึงซึ่งข้อความหรือการออกโฆษณาแห่งหนังสือพิมพ์ หรือสิ่งพิมพ์เช่นว่านั้นหรือไม่ ให้ถือว่าได้กระทำผิดฐานละเมิดอำนาจศาลในกรณีอย่างใดอย่างหนึ่งในสองอย่างดังจะกล่าวต่อไปนี้
(๑) ไม่ว่าเวลาใด ๆ ถ้าหนังสือพิมพ์หรือสิ่งพิมพ์เช่นว่ามานั้นได้กล่าวหรือแสดงไม่ว่าโดยวิธีใด ๆ ซึ่งข้อความหรือความเห็นอันเป็นการเปิดเผยข้อเท็จจริงหรือพฤติการณ์อื่น ๆ แห่งคดี หรือกระบวนพิจารณาใด ๆ แห่งคดี ซึ่งเพื่อความเหมาะสมหรือเพื่อคุ้มครองสาธารณประโยชน์ ศาลได้มีคำสั่งห้ามการออกโฆษณาสิ่งเหล่านั้น ไม่ว่าโดยวิธีเพียงแต่สั่งให้พิจารณาโดยไม่เปิดเผยหรือโดยวิธีห้ามการออกโฆษณาโดยชัดแจ้ง

English translation

Whoever is the author, editor, or publisher of a newspaper or printed matter published to the public, whether or not those persons knew of the content or of the publication of such newspaper or printed matter, shall be deemed to have committed contempt of court in either one of the two following cases:
(1) at any time, if such newspaper or printed matter has stated or shown, by whatever means, any content or opinion disclosing the facts or other circumstances of a case, or any proceedings of a case, the publication of which the court has, for the sake of propriety or for the protection of the public interest, ordered to be prohibited, whether merely by ordering that the trial be conducted without disclosure or by expressly prohibiting publication;
(2) if the newspaper or printed matter has stated or shown, by whatever means, during the trial of a case up to the time judgment becomes final, any content or opinion intended to influence the feelings of the public, or the court, or a party, or a witness in the case, in such a way that it may be seen as likely to cause the trial to lose its justice, such as:
(a) misrepresenting the facts of the case; or
(b) being a report, summary, or commentary on the proceedings of the case in a manner that is not impartial and not accurate; or
(c) being an unfair commentary on the conduct of a party's case, or on the testimony or evidence, or on the character and behaviour of a party or witness, including making statements damaging to the reputation of a party or witness, even though those statements are true; or
(d) inducing the giving of false testimony.
For the purposes of this Section, all the definitions of terms in Section 4 of the Printing Act, B.E. 2476, shall apply.

Section 32 extends contempt of court to press and print publications and, notably, imposes it on the author, editor, or publisher regardless of knowledge of the content. It has two limbs: (1) publishing matter the court has ordered not to be published, whether by a closed-proceedings order or an express publication ban; and (2) publishing, during the trial and until judgment is final, content intended to influence the public, the court, a party, or a witness in a way likely to prejudice the fairness of the trial, with four illustrative forms including misrepresentation, biased reporting, unfair commentary (even if true), and inducing false testimony. The key test under limb (2) is whether the material tends to make the trial lose its justice; matter that does not have that tendency is not contempt. Definitions in Section 4 of the Printing Act, B.E. 2476, apply.

Why this matters in practice

For journalists, editors, and publishers, Section 32 is a real exposure when reporting on live cases, because liability can attach even without knowledge of the offending content, and it reaches commentary that is true but unfair. The deciding question is usually whether the publication tends to make the trial lose its justice: reporting that does not have that effect is not contempt, but content designed to sway the court, witnesses, or the public can be. Respect any publication ban or closed-proceedings order strictly. If you publish about ongoing litigation, take legal advice before running sensitive coverage.

  1. Arrêt n° 2611/2523 de la Cour suprême (1980)

    Publishing newspaper content that insinuates a judge postponed a case unjustly, showing an intent to influence the feelings of witnesses and the court so as to cause the trial to lose its justice, makes the editor and publisher guilty of contempt under Section 32(2).

    The newspaper carried articles insinuating that the judge had postponed the case unjustly and that justice could not be found, which the Court held showed an intent to influence the feelings of witnesses and the court and to make the trial lose its justice. The editor and publisher were found guilty under Section 32(2), and the Supreme Court upheld the two-month imprisonment.

  2. Arrêt de la Cour suprême n° 1896/2531 (1988)

    Where published content does not tend to make the trial lose its justice, the author or assistant editor is not guilty of contempt of court under Section 32.

    The Court held that the published column, concerning a suit and an application to proceed as a pauper, could not be seen as likely to make the trial lose its justice. The author, who was also assistant editor of the newspaper, was therefore not guilty of contempt of court under Section 32.

  3. Arrêt de la Cour suprême n° 881/2490 (1947)

    Contempt of court under Sections 32 to 33 carries a penalty not reaching ten years' imprisonment, so on a guilty plea the court may find the facts accordingly and give judgment at once, and the punished person may not appeal to have the facts reopened.

    The Court held that contempt of court under Sections 32 to 33 is an offence whose penalty does not reach ten years' imprisonment, so under Section 176 of the Criminal Procedure Code the court could accept the guilty plea and give judgment at once. The person punished could not appeal or further appeal to have the facts reopened.

Oui.
