เมื่อมีมติพิเศษให้ควบรวมบริษัทแล้ว บริษัทต้องมีหนังสือบอกกล่าวมติดังกล่าวภายในสิบสี่วันนับแต่วันที่ได้มีมติไปยังเจ้าหนี้ของบริษัทตามรายชื่อที่ปรากฏในบัญชีของบริษัท ณ วันที่ที่ประชุมผู้ถือหุ้นลงมติให้ควบรวมบริษัท โดยกำหนดเวลาให้ส่งคำคัดค้านภายในหนึ่งเดือนนับแต่วันที่ได้รับหนังสือบอกกล่าวมตินั้น และให้บริษัทโฆษณามตินั้นทางหนังสือพิมพ์รายวันที่แพร่หลายภายในกำหนดเวลาสิบสี่วันนั้นด้วย

ถ้ามีการคัดค้าน บริษัทจะควบรวมมิได้จนกว่าจะได้ชำระหนี้หรือได้ให้ประกันเพื่อหนี้นั้นแล้ว

English translation

When a special resolution to amalgamate has been passed, the company must, within fourteen days from the date of the resolution, give written notice of the resolution to the creditors of the company whose names appear in the company's accounts as at the date on which the shareholders' meeting resolved to amalgamate, fixing a period of one month from receipt of the notice within which objections may be sent; and the company must also advertise the resolution in a widely circulated daily newspaper within that period of fourteen days.

If an objection is made, the company may not amalgamate until the debt has been paid or security has been given for it.
