Section 1464 — Maintenance and protection of a spouse of unsound mind

ในกรณีที่คู่สมรสฝ่ายใดฝ่ายหนึ่งเป็นคนวิกลจริต ไม่ว่าศาลจะได้สั่งให้เป็นคนไร้ความสามารถหรือไม่ ถ้าคู่สมรสอีกฝ่ายหนึ่งไม่อุปการะเลี้ยงดูฝ่ายที่วิกลจริตตามมาตรา ๑๔๖๑ วรรคสอง หรือกระทำการหรือไม่กระทำการอย่างใด อันเป็นเหตุให้ฝ่ายที่วิกลจริตอยู่ในภาวะอันน่าจะเกิดอันตรายแก่กายหรือจิตใจ หรือตกอยู่ในภาวะอันน่าจะเกิดความเสียหายทางทรัพย์สินถึงขนาด บุคคลตามที่ระบุไว้ในมาตรา ๒๘ หรือผู้อนุบาลอาจฟ้องคู่สมรสอีกฝ่ายหนึ่งเรียกค่าอุปการะเลี้ยงดูให้แก่ฝ่ายที่วิกลจริต หรือขอให้ศาลมีคำสั่งใด ๆ เพื่อคุ้มครองฝ่ายที่วิกลจริตนั้นได้ ในกรณีฟ้องเรียกค่าอุปการะเลี้ยงดูตามวรรคหนึ่ง ถ้ายังมิได้มีคำสั่งของศาลว่าคู่สมรสซึ่งวิกลจริตเป็นคนไร้ความสามารถก็ให้ขอต่อศาลในคดีเดียวกันให้ศาลมีคำสั่งว่าคู่สมรสซึ่งวิกลจริตนั้นเป็นคนไร้ความสามารถ โดยขอให้ตั้งตนเองหรือผู้อื่นที่ศาลเห็นสมควรเป็นผู้อนุบาล หรือถ้าได้มีคำสั่งของศาลแสดงว่าคู่สมรสซึ่งวิกลจริตเป็นคนไร้ความสามารถอยู่แล้ว จะขอให้ถอดถอนผู้อนุบาลคนเดิม และแต่งตั้งผู้อนุบาลคนใหม่ก็ได้ ในการขอให้ศาลมีคำสั่งใด ๆ เพื่อคุ้มครองคู่สมรสฝ่ายที่วิกลจริตโดยมิได้เรียกค่าอุปการะเลี้ยงดูด้วยนั้น จะไม่ขอให้ศาลมีคำสั่งให้คู่สมรสฝ่ายที่วิกลจริตนั้นเป็นคนไร้ความสามารถ หรือจะไม่ขอเปลี่ยนผู้อนุบาลก็ได้ แต่ถ้าศาลเห็นว่าวิธีการคุ้มครองที่ขอนั้นจำต้องมีผู้อนุบาลหรือเปลี่ยนผู้อนุบาล ให้ศาลมีคำสั่งให้จัดการทำนองเดียวกับที่บัญญัติไว้ในวรรคสอง แล้วจึงมีคำสั่งคุ้มครองตามที่เห็นสมควร หมายเหตุ: [เลขมาตรา ๒๘ แก้ไขเพิ่มเติมโดยมาตรา ๑๕ แห่งพระราชบัญญัติให้ใช้บทบัญญัติบรรพ ๑ แห่งประมวลกฎหมายแพ่งและพาณิชย์ที่ได้ตรวจชำระใหม่ พ.ศ. ๒๕๓๕]

English translation
Where one spouse is of unsound mind, whether or not the court has adjudged that spouse incompetent, if the other spouse fails to maintain the spouse of unsound mind under Section 1461 paragraph two, or does or fails to do anything which puts the spouse of unsound mind in a position likely to cause danger to body or mind, or likely to cause serious damage to property, the persons specified in Section 28, or the guardian, may bring an action against the other spouse claiming maintenance for the spouse of unsound mind, or may apply for any order of the court to protect that spouse.
Where an action for maintenance is brought under paragraph one and no order of the court has yet adjudged the spouse of unsound mind incompetent, application shall be made to the court in the same case for an order adjudging that spouse incompetent, asking that the applicant himself or herself, or another person whom the court thinks fit, be appointed guardian. If an order of the court has already adjudged the spouse of unsound mind incompetent, application may be made to remove the existing guardian and to appoint a new one.
Where an order of the court is applied for to protect the spouse of unsound mind without also claiming maintenance, the applicant need not ask the court to adjudge that spouse incompetent or to change the guardian. But if the court is of opinion that the measure of protection applied for requires a guardian or a change of guardian, the court shall order the same course as provided in paragraph two, and shall then make such protective order as it thinks fit.
