บทบัญญัติแห่งมาตรา ๑๖๙ วรรคสอง นั้น ท่านมิให้ใช้บังคับ ถ้าหากว่าขัดกับเจตนาอันผู้เสนอได้แสดง หรือหากว่าก่อนจะสนองรับนั้น คู่กรณีอีกฝ่ายหนึ่งได้รู้อยู่แล้วว่าผู้เสนอตายหรือตกเป็นผู้ไร้ความสามารถ หมายเหตุ: [เลขมาตรา ๑๖๙ วรรคสอง แก้ไขเพิ่มเติมโดยมาตรา ๑๕ แห่งพระราชบัญญัติให้ใช้บทบัญญัติบรรพ ๑ แห่งประมวลกฎหมายแพ่งและพาณิชย์ที่ได้ตรวจชำระใหม่ พ.ศ. ๒๕๓๕]

The provisions of Section 169 paragraph 2 do not apply, if the offeror has declared a contrary intention, or if before accepting the other party had notice of the fact of his death or loss of capacity.
