ถ้าค่าสินไหมทดแทนอันผู้รับประกันภัยได้ใช้ไปโดยคำพิพากษานั้นยังไม่คุ้มค่าวินาศภัยเต็มจำนวนไซร้ ท่านว่าผู้เอาประกันภัยก็ยังคงต้องรับใช้จำนวนที่ยังขาด เว้นไว้แต่บุคคลผู้ต้องเสียหายจะได้ละเลยเสียไม่เรียกตัวผู้เอาประกันภัยเข้ามาสู่คดีด้วยดังกล่าวไว้ในมาตราก่อน

English translation
Where the compensation paid by the insurer under a judgment does not cover the whole of the loss, the insured remains liable for the balance, unless the injured person has omitted to join the insured in the action as provided in the preceding Section.
