Where the court has not fixed a day for the examination of evidence under Section 173/1, a party wishing to cite as evidence a document in his possession shall submit that documentary evidence to the court not less than fifteen days before the day of the preliminary hearing or the day for taking evidence, so that the other party has the opportunity to inspect and request copies of the document before it is adduced, except where the document the party wishes to rely on is a record of a witness's statement, or a document showing the name or address of a witness, or where the court thinks fit to order otherwise owing to the nature and necessity of the document. In a case not subject to the duty to submit documents under paragraph one, when a document is used as evidence in court, it shall be read or handed to the parties for inspection. If a party wishes to have a copy, the court has power to order the party citing the document to give a copy to the other party as it thinks fit. If a party fails to submit a document under paragraph one, or a copy under paragraph two, or fails to submit documentary or material evidence under Section 173/2 paragraph one, the court has power to refuse to admit that evidence, unless the court considers it a matter for the interest of justice, or that the failure was not intentional and does not prejudice the other party's opportunity to conduct its case.

Where the court cancels or does not fix an evidence-examination day under Section 173/1, the case falls under Section 240, and a party must file documents in its possession at least fifteen days before the day for taking evidence so the other side can inspect and copy them.
In a narcotics case, a court order had the effect of cancelling the evidence-examination day under Section 173/2, meaning no day was fixed under Section 173/1. The Supreme Court held the case therefore fell under Section 240, whose paragraph one requires a party to file documents in its possession at least fifteen days before the day for taking evidence so the other party can inspect and copy them.

Where the court impliedly cancels the evidence-examination day, the case falls under Section 240, and a party wishing to cite documents in its possession must file them at least fifteen days before the day for taking evidence, subject to the exceptions in the section.
The trial court had rescheduled hearings in a way that impliedly cancelled the evidence-examination day. The Supreme Court held the case fell under Section 240, since no day had been fixed under Section 173/1, and paragraph one required a party citing documents in its possession to file them at least fifteen days before the day for taking evidence so the other side could inspect and copy them.

Under Section 240, where the prosecutor submits documents at the time a witness testifies and the court lets the defendant inspect them, the court may admit those documents as evidence without needing to have provided copies to the defendant before the hearing.
The prosecutor submitted documents while a witness was testifying and the court allowed the defendant to inspect them. The Supreme Court held that under Section 240 the court could admit those documents as evidence, and there was no need to have furnished copies to the defendant before the hearing.
