ถ้าผู้ทรงสิทธิเหนือพื้นดินละเลยไม่ปฏิบัติตามเงื่อนไขอันเป็นสาระสำคัญซึ่งระบุไว้ในนิติกรรมก่อตั้งสิทธินั้นก็ดี หรือถ้ามีค่าเช่าซึ่งจะต้องให้แก่กัน แต่ผู้ทรงสิทธิเหนือพื้นดินละเลยไม่ชำระถึงสองปีติด ๆ กันก็ดี ท่านว่าคู่กรณีอีกฝ่ายหนึ่งจะบอกเลิกสิทธิเหนือพื้นดินก็ได้

If the superficiary fails to comply with essential conditions specified in the act creating superficies or, when rent is to be paid, he fails to pay it for two consecutive years, his right of superficies may be terminated.
