The right of superficies is not extinguished by destruction of the buildings, structures or plantations even if caused by force majeure.

Section 1415 provides two extinguishment routes. Voluntary abandonment is straightforward, the superficiary surrenders the registration. Involuntary extinguishment by court order requires 5 years of consecutive non-use plus the landowner's petition. "Non-use" is fact-specific, leaving a house empty seasonally is not typically enough; complete absence and no maintenance for 5+ years is.
