สิทธิเหนือพื้นดินนั้นไม่สิ้นไปโดยเหตุที่โรงเรือน สิ่งปลูกสร้าง หรือสิ่งเพาะปลูกสลายไป แม้การสลายนั้นจะเป็นเพราะเหตุสุดวิสัย

มาตรา 1415 คุ้มครองผู้ทรงสิทธิเหนือพื้นดินเมื่อสิ่งปลูกสร้างเสียหายหรือสูญสิ้นไป หลักคือตัวสิทธิเหนือพื้นดินผูกอยู่กับที่ดิน มิได้ผูกอยู่กับตัวอาคาร ดังนั้นเมื่อโรงเรือน สิ่งปลูกสร้าง หรือสิ่งเพาะปลูกสลายไป ไม่ว่าจะด้วยอัคคีภัย อุทกภัย หรือเหตุสุดวิสัยอื่น สิทธิเหนือพื้นดินยังคงอยู่ และผู้ทรงสิทธิย่อมปลูกสร้างขึ้นใหม่ได้ภายในขอบเขตของสิทธิที่ตนมี ในทางปฏิบัติ ข้อนี้มีความสำคัญต่อการวางโครงสร้างระยะยาว เพราะทำให้ความเสียหายต่อสิ่งปลูกสร้างไม่ทำให้สิทธิในที่ดินสูญไปด้วย ส่วนสิ่งที่เกิดขึ้นเมื่อสิทธิเหนือพื้นดินสิ้นไปเป็นเรื่องของมาตรา 1416 ซึ่งให้ผู้ทรงสิทธิรื้อถอนสิ่งปลูกสร้างของตนไปได้ โดยต้องทำให้ที่ดินเป็นตามเดิม เว้นแต่เจ้าของที่ดินจะบอกเจตนาซื้อตามราคาท้องตลาด
