Section 1415 provides two extinguishment routes. Voluntary abandonment is straightforward — the superficiary surrenders the registration. Involuntary extinguishment by court order requires 5 years of consecutive non-use plus the landowner's petition. "Non-use" is fact-specific — leaving a house empty seasonally is not typically enough; complete absence and no maintenance for 5+ years is.
