Article 255: Criteria for granting provisional measures

ในการพิจารณาอนุญาตตามคำขอที่ยื่นไว้ตามมาตรา ๒๕๔ ต้องให้เป็นที่พอใจของศาลว่า คำฟ้องมีมูลและมีเหตุเพียงพอที่จะนำวิธีคุ้มครองตามที่ขอนั้นมาใช้ได้ตามหลักเกณฑ์ดังต่อไปนี้
(๑) ในกรณีที่ยื่นคำขอให้ศาลมีคำสั่งตามมาตรา ๒๕๔
(๑) ต้องให้เป็นที่พอใจของศาลว่า (ก) จำเลยตั้งใจจะยักย้ายทรัพย์สินที่พิพาทหรือทรัพย์สินของตนทั้งหมดหรือแต่บางส่วนไปให้พ้นจากอำนาจศาล หรือจะโอน ขายหรือจำหน่ายทรัพย์สินดังกล่าวเพื่อประวิงหรือขัดขวางต่อการบังคับตามคำบังคับใด ๆ ซึ่งอาจจะออกบังคับเอาแก่จำเลยหรือเพื่อจะทำให้โจทก์เสียเปรียบ หรือ (ข) มีเหตุจำเป็นอื่นใดตามที่ศาลจะพิเคราะห์เห็นเป็นการยุติธรรมและสมควร
(๒) ในกรณีที่ยื่นคำขอให้ศาลมีคำสั่งตามมาตรา ๒๕๔
(๒) ต้องให้เป็นที่พอใจของศาลว่า (ก) จำเลยตั้งใจจะกระทำซ้ำหรือกระทำต่อไปซึ่งการละเมิด การผิดสัญญา หรือการกระทำที่ถูกฟ้องร้อง (ข) โจทก์จะได้รับความเดือดร้อนเสียหายต่อไปเนื่องจากการกระทำของจำเลย (ค) ทรัพย์สินที่พิพาทหรือทรัพย์สินของจำเลยนั้นมีพฤติการณ์ว่าจะมีการกระทำให้เปลืองไปเปล่าหรือบุบสลายหรือโอนไปยังผู้อื่น หรือ (ง) มีเหตุตาม
(๑) (ก) หรือ (ข)
(๓) ในกรณีที่ยื่นคำขอให้ศาลมีคำสั่งตามมาตรา ๒๕๔
(๓) ต้องให้เป็นที่พอใจของศาลว่า (ก) เป็นที่เกรงว่าจำเลยจะดำเนินการให้มีการจดทะเบียน แก้ไขเปลี่ยนแปลงทางทะเบียน หรือเพิกถอนการจดทะเบียนเกี่ยวกับทรัพย์สินที่พิพาทหรือทรัพย์สินของจำเลยหรือที่เกี่ยวกับการกระทำที่ถูกฟ้องร้อง ซึ่งการดำเนินการดังกล่าวจะก่อให้เกิดความเสียหายแก่โจทก์ หรือ (ข) มีเหตุตาม
(๑) (ข)
(๔) ในกรณีที่ยื่นคำขอให้ศาลมีคำสั่งตามมาตรา ๒๕๔
(๔) ต้องให้เป็นที่พอใจของศาลว่า เพื่อที่จะประวิงหรือขัดขวางต่อการพิจารณาคดีหรือการบังคับตามคำบังคับใด ๆ ซึ่งอาจจะออกบังคับเอาแก่จำเลย หรือเพื่อจะทำให้โจทก์เสียเปรียบ (ก) จำเลยซ่อนตัวเพื่อจะไม่รับหมายเรียกหรือคำสั่งของศาล (ข) จำเลยได้ยักย้ายไปให้พ้นอำนาจศาลหรือซุกซ่อนเอกสารใด ๆ ซึ่งพอจะเห็นได้ว่าจะใช้เป็นพยานหลักฐานยันจำเลยในคดีที่อยู่ในระหว่างพิจารณา หรือทรัพย์สินที่พิพาทหรือทรัพย์สินของจำเลยทั้งหมดหรือแต่บางส่วน หรือเป็นที่เกรงว่าจำเลยจะจำหน่ายหรือทำลายเอกสารหรือทรัพย์สินเช่นว่านั้น หรือ (ค) ปรากฏตามกิริยาหรือตามวิธีที่จำเลยประกอบการงานหรือการค้าของตนว่าจำเลยจะหลีกหนีหรือพอเห็นได้ว่าจะหลีกหนีไปให้พ้นอำนาจศาล
English translation
In considering whether to grant an application filed under Section 254, the court must be satisfied that the complaint has merit and that there are sufficient grounds to apply the protective measure requested, in accordance with the following criteria:
(1) Where an application is filed for the court to issue an order under Section 254(1), it must be satisfied by the court that (a) the defendant intends to remove the disputed property, or all or part of the defendant's own property, beyond the power of the court, or to transfer, sell, or dispose of such property in order to delay or obstruct the enforcement of any writ of execution that may be issued against the defendant, or to place the plaintiff at a disadvantage; or (b) there is any other necessary cause that the court considers just and proper.
(2) Where an application is filed for the court to issue an order under Section 254(2), it must be satisfied by the court that (a) the defendant intends to repeat or continue the tortious act, the breach of contract, or the act complained of; (b) the plaintiff will suffer further hardship or damage from the defendant's act; (c) the disputed property or the defendant's property is under circumstances showing that it will be wastefully expended, damaged, or transferred to another; or (d) there is a cause under (1)(a) or (b).
(3) Where an application is filed for the court to issue an order under Section 254(3), it must be satisfied by the court that (a) there is concern that the defendant will bring about the registration, the alteration of an entry in the register, or the cancellation of registration relating to the disputed property or the defendant's property, or relating to the act complained of, and such action would cause damage to the plaintiff; or (b) there is a cause under (1)(b).
(4) Where an application is filed for the court to issue an order under Section 254(4), it must be satisfied by the court that, in order to delay or obstruct the proceedings or the enforcement of any writ of execution that may be issued against the defendant, or to place the plaintiff at a disadvantage, (a) the defendant conceals himself so as to avoid receiving a summons or an order of the court; (b) the defendant has removed beyond the power of the court, or concealed, any document that may be seen as usable as evidence against the defendant in the pending case, or the disputed property or all or part of the defendant's property, or there is concern that the defendant will dispose of or destroy such document or property; or (c) it appears from the defendant's conduct, or the manner in which the defendant carries on his business or trade, that the defendant will abscond or may be seen to be about to abscond beyond the power of the court.

Section 255 is the evidentiary gatekeeper for provisional measures before judgment in Book 4, Title 1, Chapter 1. It pairs with Section 254, which lists the measures a plaintiff may request; Section 255 states the threshold the court must find satisfied before granting each one. The core test is twofold: the complaint must have merit, and there must be sufficient grounds matching the specific conduct described for each measure, such as an intent to remove or dispose of assets, to repeat a wrong, to alter a registration, or to abscond. The criteria are cross-referenced, so grounds under subsection (1) can also support measures under subsections (2) and (3).
Why this matters in practice
The court will usually hold an inquiry to test the alleged grounds before granting or refusing an interim measure, and dismissing an application without any inquiry into the facts can be improper. A bare assertion that the defendant might move assets or change a registration, without supporting facts, is treated as speculation and will not meet the threshold, so an applicant should come with concrete evidence. For creditors, a well-supported attachment before judgment can be decisive to later debt recovery.

Where the applicant alleges that the opposing party intends to transfer, sell, or dispose of property to obstruct enforcement, the criteria in Section 255(1)(a) may be met, and the court should hold an inquiry into the truth of the facts rather than dismiss the application without inquiry.
The applicant alleged the opposing party intended to dispose of property to obstruct enforcement of an arbitral award. The Supreme Court held that, if the alleged facts were true, there were sufficient grounds under Section 255(1)(a), and that the lower court's hasty dismissal of the application without an inquiry was improper. The case was remanded for the trial court to conduct an inquiry and rule afresh.

A mere estimate or speculation that the defendant will alter a registration entry, without concrete supporting facts, does not satisfy Section 255 that the defendant intends to remove property beyond the power of the court.
The plaintiff's application rested only on a prediction that the defendant would change a registration entry. The Supreme Court held this was mere speculation and did not meet the Section 255 requirement, read with Section 254(1), that the court be satisfied the defendant intends to remove property beyond the court's power.

Que doit prouver un demandeur pour obtenir une mesure provisoire en vertu de l'article 255 ?
Le demandeur doit convaincre le tribunal du bien-fondé de sa plainte et de l'existence de motifs précis justifiant la mesure demandée, par exemple que le défendeur a l'intention de soustraire ou de céder des biens à la juridiction du tribunal. De simples soupçons ne suffisent pas.
