traduction anglaise
Unless otherwise provided by law or ordered by the court, the executing officer is prohibited from seizing the property or attaching the claims of the judgment debtor, or from selling by public auction or otherwise disposing of property or claims obtained from seizure or attachment, in a quantity exceeding what is sufficient to satisfy the debt owed to the judgment creditor together with the court fees and the fees of execution.
Where it is necessary to seize property or attach a claim whose value exceeds what is sufficient to satisfy the debt owed to the judgment creditor, if that property or claim is in a condition that can be seized or attached in part without causing damage, the executing officer has the power to seize or attach only a portion, or only a share of the ownership, of that property or claim to the extent sufficient to satisfy the debt owed to the judgment creditor together with the court fees and the fees of execution.
A person having an interest in the execution may object to an order or an act of the executing officer under paragraph one or paragraph two by filing a motion with the court before the day of the public auction or other disposal, but no later than fifteen days from the day of learning of that order or act. The order of the court shall be final.

Annotation de l'entreprise
This is the rule against over-seizure in Part 1 on the powers of the executing officer, protecting the judgment debtor from having assets locked up or sold beyond what the debt requires. Paragraph two adds a proportionality tool: divisible assets should be seized only in part. Paragraph three gives an interested person a right to object to the court before the sale, with the order made final. Recent Supreme Court decisions confirm that the finality in paragraph three attaches to genuine over-seizure objections and does not shield every execution order from appeal.
Pourquoi cela est important en pratique
If the officer seizes far more than the debt, or refuses to divide a splittable asset, move quickly: the objection must reach the court before the auction and within fifteen days of learning of the act. Because the court's order is final on a true over-seizure point, framing the motion correctly matters. Debtors facing aggressive enforcement often raise this together with a review of the debt amount.

-
Supreme Court Judgment No. 4942/2566 (2023)
The finality granted by Section 300, paragraph three, attaches only to a court order deciding a genuine objection that the officer seized or attached property in excess of the debt; where the objection is not of that kind, the order is not final and can be reviewed on appeal.
The debtor's challenge concerned the certain amount of the judgment debt, not an over-seizure objection. The Court held that the order revoking the attachment was therefore not final under Section 300, paragraph three, and upheld the appellate court.

Supreme Court Judgment No. 2498/2566 (2023)
Even where the plaintiff wins the full claim as prayed for, enforcement of the judgment remains subject to Section 300, which forbids the executing officer from seizing or attaching property in excess of what is sufficient to satisfy the debt together with fees.
The Court explained that a full judgment in the creditor's favour does not lift the over-seizure ceiling: execution still operates within Section 300's limit measured against the debt plus court and execution fees.
