Article 140 — How judgments and orders are made and read

การทำคำพิพากษาหรือคำสั่งของศาลให้ดำเนินตามข้อบังคับต่อไปนี้
(๑) ศาลจะต้องประกอบครบถ้วนตามบทบัญญัติแห่งกฎหมายว่าด้วยเขตอำนาจศาล และอำนาจผู้พิพากษา
(๒) ภายใต้บังคับบทบัญญัติมาตรา ๑๓ ถ้าคำพิพากษาหรือคำสั่งจะต้องทำโดยผู้พิพากษาหลายคน คำพิพากษาหรือคำสั่งนั้นจะต้องบังคับตามความเห็นของฝ่ายข้างมาก ในศาลชั้นต้นและศาลชั้นอุทธรณ์ ถ้าผู้พิพากษาคนใดมีความเห็นแย้งก็ให้ผู้พิพากษาคนนั้นเขียนใจความแห่งความเห็นแย้งและเหตุผลของตนกลัดไว้ในสำนวน

The making of a judgment or order of the court shall follow these rules:
(1) The court must be fully constituted in accordance with the provisions of law on the jurisdiction of courts and the authority of judges.
(2) Subject to the provisions of Section 13, if a judgment or order must be made by several judges, that judgment or order must follow the opinion of the majority. In the court of first instance and the appeal court, if any judge dissents, that judge shall write the substance of the dissenting opinion and its reasons and attach it to the case file.
In the appeal court or the Supreme Court, if the president of the appeal court or the President of the Supreme Court, as the case may be, considers it appropriate, a question in any case may be decided by the full court or by the division; and if a law requires a question or a case to be decided by the full court or the division, it shall be decided by the full court or the division, as the case may be.
Subject to the provisions of Section 13, in the absence of any law providing otherwise, the full court or the division of the appeal court or the Supreme Court shall consist of all the judges on duty, but not fewer than one half of the number of judges in that court or in the division holding the meeting, and the president of the appeal court or the President of the Supreme Court, the president of the division of the appeal court or the Supreme Court, as the case may be, or the person acting in that capacity, shall preside.
The decision of the full court or the division shall follow the majority of votes, and if the votes are equal, the president of the meeting shall cast an additional deciding vote.
In a case in which the full court or the division has decided a question, the judgment or order must follow the decision of the full court or the division, and it must state which questions were decided by the full court or the division. Judges who attended the meeting, even if they were not the judges who sat at the trial, have the power to give judgment or make the order in that case, and, only in the appeal court, may also make a dissenting opinion with reasons.
Where a question in any case has been decided by the division, if the president of the appeal court or the President of the Supreme Court, as the case may be, considers it appropriate, that question may be decided again by the full court.
(3) The reading of a judgment or order shall be a reading of the whole text in open court, at the time fixed in this Code, before both parties or one of them. In such a case, the court shall note it in the judgment or order or in a report of the reading, and the parties present in court shall sign as evidence. If the parties do not come to court, the court may dispense with the reading of the judgment or order; in such a case the court shall record it in a report, and the judgment or order shall be deemed to have been read according to law. On the day the court that decided the case, or that was ordered by a higher court to read the judgment or order, reads the judgment or order under this section, that day shall be deemed the day of judgment or order in that case.

Section 140 sets out the formal requirements for making and pronouncing judgments and orders, a cornerstone of the Chapter on the content and effect of judgments. Item (1) requires a properly constituted court; item (2) governs decision by majority, the recording of dissents, and decision by the full court or a division in the appeal court and Supreme Court, subject to Section 13; and item (3) governs the reading of the judgment. The reading rule is significant because the day of reading, or deemed reading where parties are absent, fixes the date of judgment, which starts appeal and finality clocks under Sections 147 and following. Much of the case law under this section turns on item (3).

  1. Supreme Court Judgment No. 6112/2554 (2011)

    In a civil case, if a party duly notified of the reading fails to attend, the court may dispense with reading the judgment under Section 140(3), record it, and the judgment is then deemed lawfully read from the appointed date.

    The court explained that where a party is duly notified but does not attend on the reading date, Section 140(3) lets the court omit the reading and record it, after which the judgment is deemed lawfully read from that date. This is a procedural step that lets civil proceedings continue to conclusion.

  2. Supreme Court Judgment No. 3302/2551 (2008)

    Until the appeal court's judgment is read to the parties under Section 140(3), the case is still regarded as pending before the appeal court, so an order made in the interim is an interlocutory order.

    Because the court of first instance had not yet read the appeal court's judgment, the case was still pending in the appeal court under Section 140(3) final paragraph. An order requiring additional appeal court fees was therefore an interlocutory order that could not be separately appealed during the proceedings.

  3. Supreme Court Judgment No. 8957/2556 (2013)

    The reading of a judgment under Section 140(3) means reading the whole text in open court before the parties, and the meaning of that requirement was the issue in deciding whether the reading of an appeal court judgment should be set aside.

    The objector sought to set aside the reading of an appeal court judgment, arguing over the meaning of Section 140(3), which requires reading the whole text in open court before the parties with those present signing. The court examined that requirement in deciding whether there was ground to cancel the reading.

Under Section 140(3) the court may dispense with the reading, record it in a report, and the judgment is deemed to have been read according to law, so time limits still run.
