Article 27 — Setting aside irregular proceedings

Where there has been a failure to comply with the provisions of this Code on matters intended to ensure that justice is done, or relating to public order, concerning the drafting and the filing or service of pleadings or other documents, or concerning the trial of the case, the taking of evidence, or the execution of a judgment, then, when the court thinks fit or when a party aggrieved by such failure files a request made in the form of a motion, the court has the power to order that the irregular proceedings be set aside, in whole or in part, or to order that they be corrected, or to make any other order in the matter as the court thinks fit.
An objection on the ground of such irregularity may be raised by the aggrieved party at any time before judgment, but not later than eight days from the day on which that party became aware of the facts or circumstances constituting the ground of the objection; provided, however, that the party must not have taken any new step after becoming aware of the irregularity, and must not have ratified that irregularity.
Where the court orders the setting aside of any irregular proceedings, other than a case in which the party has failed to carry out a procedural step within the time fixed by law or by the court, this alone does not deprive that party of the right to carry out such procedural step anew in the proper manner required by law.

Section 27 is the Code's general remedy for irregular proceedings (กระบวนพิจารณาที่ผิดระเบียบ). It applies to breaches of rules aimed at securing justice or protecting public order across drafting, filing and service, trial, evidence, and execution. The court may act on its own motion or on an aggrieved party's motion, and may set aside, correct, or otherwise deal with the irregularity. The second paragraph imposes strict limits on a party's objection: it must be made before judgment, within eight days of learning the grounds, without taking a new step and without ratifying the irregularity. Where the irregularity concerns public order, higher courts may raise it on their own, and the eight-day limit for a party's objection does not bar the court itself.

If a procedural mistake has hurt your position, Section 27 is your route to fix or unwind it, but the clock is tight: raise it before judgment and within eight days of learning the facts, and do not take any fresh step in the meantime or you may be treated as accepting the irregularity.   1. Supreme Court Judgment No. 2651/2568 (2025)

    Where proceedings are conducted contrary to procedure on a matter concerning public order, the Supreme Court may raise the point on its own and set aside the irregular proceedings under Section 27, paragraph one.

    The trial court's order forwarding the file and the appeal court's acceptance and adjudication were held not in accordance with procedure, a matter of public order that the Supreme Court could raise on its own. The Court set aside the irregular proceedings under Section 27, paragraph one, vacated the resulting orders and judgment, and rejected the further appeal as raising a point not properly litigated below.

  2. Supreme Court Judgment No. 1001/2568 (2025)

    Where a judgment was read to a party improperly, the court may act under Section 27 to have it read again properly; the time to appeal begins only from a lawful reading of the judgment.

    Because the objector could not be treated as having known the date to hear the judgment, the appeal court properly vacated the trial court's order and judgment and directed a fresh, proper reading under Section 27. Since the earlier reading was unlawful, the objector's time to appeal had not yet begun to run.

  3. Supreme Court Judgment No. 817/2568 (2025)

    Setting aside irregular proceedings in a narcotics case is governed by Section 27 (via Section 15 of the Criminal Procedure Code and the Narcotics Case Procedure Act): there must be a failure to comply with a provision aimed at justice, raised by the court itself or by an aggrieved party's motion.

    The Court set out the framework for setting aside irregular proceedings in a narcotics case, applying Section 27 through Section 15 of the Criminal Procedure Code and the Narcotics Case Procedure Act.
