ให้ศาลอุทธรณ์มีอำนาจดังต่อไปนี้ด้วย คือ

The Court of Appeal shall also have the following powers:
(1) Where a case shows that the provisions of this Code on judgments and orders have not been complied with, and the Court of Appeal is of the view that there is reasonable cause, it shall order that the judgment or order of the court of first instance be set aside and shall return the record to the court of first instance for a new judgment or order. In such a case the court of first instance may be composed of judges other than those who gave the earlier judgment or order, and the new judgment or order may decide the case differently from the judgment or order that was set aside.
(2) Where a case shows a cause of non-compliance with the provisions of this Code on trial procedure, or a cause where the court refused to take evidence requested by the appellant, and the Court of Appeal is of the view that there is reasonable cause, it shall order the judgment or order of the court of first instance to be set aside, and shall direct the court of first instance, composed of the same panel of judges or other judges, or such other court of first instance as the Court of Appeal thinks fit, to try the case again in whole or in part and give a new judgment or order.
(3) Where the Court of Appeal must accept the facts as found by the court of first instance, if it appears that (a) the court of first instance found those facts contrary to law, the Court of Appeal may find new facts in place of the facts found by the court of first instance and give a judgment or order deciding the case accordingly; or (b) the facts found by the court of first instance are insufficient for deciding a question of law, the Court of Appeal may order the judgment or order of the court of first instance to be set aside and direct the court of first instance, composed of the same panel of judges or other judges, or such other court of first instance as it thinks fit, to try the case again in whole or in part in accordance with the Court of Appeal's ruling and give a judgment or order deciding the case on its merits. In all such cases, whether or not it appears from the appeal, where the court of first instance has given a new judgment or order under this section, the parties are entitled to appeal such new judgment or order to the Court of Appeal under the provisions of this Title.

Section 243 gives the Court of Appeal corrective powers that go beyond the four dispositions in Section 242, letting it cure defects at the trial level rather than decide the merits itself. Item (1) targets defects in the judgment or order, item (2) targets defective trial procedure or a wrongful refusal to take evidence, and item (3) deals with fact-finding: sub-item (a) where the trial court found facts unlawfully, and sub-item (b) where the facts found are insufficient to answer a question of law. The final paragraph preserves the parties' right to appeal any new judgment the trial court makes on remand. Through Section 252, the Supreme Court exercises the same remand powers on a dika.

If your case was decided on a defective record, a wrongly refused witness, or fact-finding that ignored the law, an appeal under Section 243 may not win you the judgment outright but can reset the case for a proper trial. A remand can add many months, and the trial may be reheard by a different panel of judges, so weigh the delay against the chance of a better outcome. Supreme Court Judgment No. 4208/2567 (2024)
Where the provisions of the Code on judgments and orders were not complied with and there is reasonable cause, the appellate court may set aside the judgment and return the record for a new judgment under Section 243(1), applied on dika through Section 252.
Because the Court of Appeal's judgment breached the Code's rules on judgments and orders and there was reasonable cause, the Supreme Court set that judgment aside and returned the record to the Court of Appeal to give a fresh judgment, applying Section 243(1) with Section 252.

Supreme Court Judgment No. 8267/2567 (2024)
Where trial procedure was defective and the defendant intended throughout to contest the case, there is reasonable cause to set aside the judgments of both lower courts and order a fresh trial and judgment under Section 243(2), applied on dika through Section 252.
The lower courts' judgments were improper because of a procedural defect, and the defendant had wished to defend throughout. The Supreme Court set aside both judgments and directed the court of first instance to reopen the proceedings and give a new judgment, under Section 243(2) with Section 252.

Where the facts found below are insufficient to decide the case, the court may set aside and remand for the lower court to find the necessary facts and give a new judgment under Section 243(3)(b), applied on dika through Section 252.
The labour court had not yet found facts on how wages were paid, which were needed to decide the case. The Supreme Court remanded for those facts to be found and a fresh judgment given, applying Section 243(3)(b) with Section 252.
