Annotation de l'entreprise

Section 15 is the bridge that lets the Civil Procedure Code fill procedural gaps in criminal cases. It applies only where the Criminal Procedure Code has no specific rule, and only "insofar as applicable," so a civil rule that clashes with the nature of criminal proceedings will not be imported. In practice it is the doorway to civil rules on setting aside irregular proceedings, on the scope of appeals to the Court of Appeal and the Supreme Court, and on many mechanical steps the criminal Code leaves unaddressed. It also carries into specialized statutes: through the Narcotics Case Procedure Act and similar laws, Section 15 lets the relevant Civil Procedure provisions reach those cases too.

Pourquoi cela est important en pratique

This section quietly shapes many procedural arguments. If your lawyer wants to strike out an irregular step, or you are testing whether an appeal point is even allowed, the answer often comes from a Civil Procedure Code rule imported through Section 15, not from the criminal Code itself. A common trap: a new factual argument raised for the first time on appeal can be barred under Civil Procedure Code Section 225 via Section 15, so points must be raised at trial. Because the interaction between the two codes is technical, it is worth having a licensed Thai lawyer map out which rule actually governs before you file.

Décisions de la Cour suprême interprétant cette section

  1. Supreme Court Judgment No. 817/2568 (2025)

The power to set aside irregular proceedings, even in narcotics cases, comes from Civil Procedure Code Section 27 applied through Criminal Procedure Code Section 15; it requires a failure to follow a civil-procedure rule aimed at ensuring a fair trial.

Deciding whether an irregular proceeding could be revoked, the Court explained that the power rests on Civil Procedure Code Section 27 read with Criminal Procedure Code Section 15 and the Narcotics Case Procedure Act. Revocation is available when a civil-procedure rule meant to secure justice was not followed and an affected party applies, or the court sees fit.

  2. Supreme Court Judgment No. 1543/2568 (2025)

A factual issue not properly raised in the trial and appeal courts, but argued for the first time on final appeal, is barred under Civil Procedure Code Sections 225 paragraph one and 252 applied through Criminal Procedure Code Section 15.

The defendant argued for the first time on final appeal that a divorce registration was a sham. The Court refused to consider it, holding the point barred under Civil Procedure Code Sections 225 paragraph one and 252, applied to the criminal case through Section 15.

  3. Supreme Court Judgment No. 5681/2568 (2025)

The restriction on appealing factual findings under Civil Procedure Code Section 225 applies to criminal cases through Criminal Procedure Code Section 15, subject to the special appeal rules for serious charges.

The Court addressed whether an appellate finding was barred under Civil Procedure Code Section 225 read with Section 15. It noted that where the charge carries a high penalty and falls under the guilty-plea proof rule of Section 176 paragraph one, the ordinary bar is qualified accordingly.
