ถ้าคู่สมรสฝ่ายใดที่ยังมีชีวิตอยู่เป็นผู้รับประโยชน์ตามสัญญาประกันชีวิต คู่สมรสฝ่ายนั้นมีสิทธิรับจำนวนเงินทั้งหมดที่ได้ตกลงไว้กับผู้รับประกันภัย แต่จำต้องเอาจำนวนเบี้ยประกันภัย เพียงเท่าที่พิสูจน์ได้ว่าสูงกว่าจำนวนเงินที่ผู้ตายจะพึงส่งใช้เป็นเบี้ยประกันภัยได้ตามรายได้หรือฐานะของตนโดยปกติไปชดใช้สินเดิมของคู่สมรสอีกฝ่ายหนึ่ง หรือสินสมรส แล้วแต่กรณีถึงอย่างไรก็ดี จำนวนเงินเบี้ยประกันภัยซึ่งจะพึงส่งคืนตามบทบัญญัติข้างต้นนั้น รวมทั้งสิ้นต้องไม่เกินจำนวนเงินที่ผู้รับประกันภัยได้ชำระให้

English translation
Where a surviving spouse is the beneficiary under a contract of life insurance, that spouse is entitled to the whole of the sum agreed with the insurer, but must restore to the other spouse's original property, or to the marital property as the case may be, so much of the premiums as is proved to exceed what the deceased could ordinarily have paid out of his income or standing.
In any event, the total premiums to be restored under the preceding paragraph must not exceed the sum paid by the insurer.
