กองมรดกย่อมตกทอดแก่ทายาทโดยสิทธิตามกฎหมายหรือโดยพินัยกรรมทายาทที่มีสิทธิตามกฎหมาย เรียกว่า “ทายาทโดยธรรม”ทายาทที่มีสิทธิตามพินัยกรรม เรียกว่า “ผู้รับพินัยกรรม”
