กองมรดกย่อมตกทอดแก่ทายาทโดยสิทธิตามกฎหมายหรือโดยพินัยกรรมทายาทที่มีสิทธิตามกฎหมาย เรียกว่า “ทายาทโดยธรรม”ทายาทที่มีสิทธิตามพินัยกรรม เรียกว่า “ผู้รับพินัยกรรม”

English translation
An estate devolves on the heirs either by operation of law or by will.
An heir entitled by operation of law is called a "statutory heir". An heir entitled under a will is called a "beneficiary under the will".
