Section 43 allows businesses lawfully operating under the Alien Business Law B.E. 2515 to continue during the FBA transition period with conditions.

มาตรา 43 คนต่างด้าวซึ่งประกอบธุรกิจอยู่ก่อนวันที่พระราชบัญญัตินี้ใช้บังคับ และธุรกิจนั้นเป็นธุรกิจตามบัญชีท้ายพระราชบัญญัตินี้ ให้คนต่างด้าวนั้นประกอบธุรกิจต่อไปได้ แต่ต้องปฏิบัติตามเงื่อนไขที่กำหนดในมาตรา 44
English Translation
Section 43. A foreigner who was operating a business before the date this Act came into force, and such business is a business under the lists annexed to this Act, may continue to operate such business, but shall comply with the conditions prescribed in Section 44.

EN: This transitional provision protected existing foreign businesses from immediate disruption when the FBA replaced the Alien Business Law in 2000. Grandfathering provisions are common in regulatory reform to avoid retroactive application of new restrictions.
