เมื่อศาลสั่งรับคำร้องขอไว้แล้ว ให้ส่งสำเนาคำร้องขอแก่โจทก์หรือเจ้าหนี้ตามคำพิพากษา จำเลยหรือลูกหนี้ตามคำพิพากษา และเจ้าพนักงานบังคับคดี เมื่อเจ้าพนักงานบังคับคดีได้รับคำร้องขอเช่นว่านี้ ถ้าทรัพย์สินที่ยึดนั้นไม่ใช่ทรัพย์สินตามมาตรา ๓๓๒ ให้งดการขายทอดตลาดหรือจำหน่ายทรัพย์สินนั้นไว้ในระหว่างรอคำวินิจฉัยชี้ขาด และให้ศาลพิจารณาและชี้ขาดตัดสินคดีนั้นเหมือนอย่างคดีธรรมดา
โจทก์หรือเจ้าหนี้ตามคำพิพากษาอาจยื่นคำร้องว่าคำร้องขอนั้นไม่มีมูลและยื่นเข้ามาเพื่อประวิงการบังคับคดี เมื่อปรากฏพยานหลักฐานเบื้องต้นว่าคำร้องนั้นฟังได้ ศาลมีอำนาจสั่งให้ผู้กล่าวอ้างวางเงินหรือหาประกันต่อศาลตามจำนวนและภายในระยะเวลาที่ศาลเห็นสมควร เพื่อเป็นประกันการชำระค่าสินไหมทดแทนแก่โจทก์หรือเจ้าหนี้ตามคำพิพากษาสำหรับความเสียหายที่อาจได้รับจากการยื่นคำร้องขอนั้น ถ้าผู้กล่าวอ้างไม่ปฏิบัติตามคำสั่งศาล ให้ศาลมีคำสั่งจำหน่ายคดีออกจากสารบบความ ส่วนเงินหรือประกันที่วางไว้ต่อศาลดังกล่าว เมื่อศาลเห็นว่าไม่มีความจำเป็นต่อไป จะสั่งคืนหรือยกเลิกประกันนั้นก็ได้ คำสั่งของศาลตามวรรคนี้ให้เป็นที่สุด

English translation
Subject to Section 55, any person who alleges that the defendant or the judgment debtor is not the owner of the property that the execution officer has seized, or that he is a co-owner having ownership or possessory rights in that property being immovable property whose possession has been divided into definite portions, or that he is a co-owner of that property being divisible movable property, or that he is a person in a position to have his right in that property registered in priority, may apply to have that property released in whole or in part, or only his own portion, as the case may be, by filing an application with the court that issued the writ of execution within sixty days from the date of the seizure of that property. However, if he is unable to file the application within that period, he may file it after the lapse of such period only where there are special circumstances, and not later than seven days before the date fixed by the execution officer for the first auction or other disposal of that property, except in the case of force majeure, in which case he may file the application later, but must do so before the auction or other disposal of that property.
In the case of property under Section 332, the person making the allegation may file an application with the court within sixty days from the date of the seizure of that property. However, if he is unable to file within that period, he may file it after the lapse of such period only where there are special circumstances, but must do so before the execution officer pays the money obtained from the sale of that property to the judgment creditor under Section 339, or before the distribution account showing the amount from the sale of that property becomes final under Section 340, as the case may be. In this regard, the net amount obtained from the sale shall be deemed to be the property sought to be released.
When the court has ordered the application to be accepted, a copy of the application shall be served on the plaintiff or the judgment creditor, the defendant or the judgment debtor, and the execution officer. When the execution officer has received such an application, if the seized property is not property under Section 332, the auction or disposal of that property shall be stayed pending the ruling, and the court shall try and adjudicate the case in the same manner as an ordinary case.
The plaintiff or the judgment creditor may file a motion that the application has no merit and was filed to delay the execution. When there is prima facie evidence that the motion is well founded, the court has the power to order the person making the allegation to deposit money or provide security with the court in the amount and within the time the court thinks fit, as security for the payment of compensation to the plaintiff or the judgment creditor for the damage that may be sustained from the filing of that application. If the person making the allegation fails to comply with the order of the court, the court shall order the case struck off the cause list. As for the money or security deposited with the court, the court may order its return or the cancellation of the security when it is of the opinion that it is no longer necessary. The order of the court under this paragraph shall be final.
In the case where the court has dismissed the application filed under paragraph one or paragraph two, if the plaintiff or the judgment creditor who has sustained damage from the filing of that application is of the opinion that the application had no merit and was filed to delay the execution, that person may file a motion with the court within thirty days from the date the court dismissed the application, seeking an order that the person making the allegation pay compensation for the damage sustained. In such a case, the court has the power to order the matter to be tried as a separate case from the original case, and when the court has held an inquiry and is of the opinion that the motion is well founded, it shall order the person making the allegation to pay compensation in such amount as it thinks fit. If that person fails to comply with the order of the court, the plaintiff or the judgment creditor may apply to the court to enforce against that person as though he were a judgment debtor.

Section 323 is the release-of-property mechanism, often called the third-party claim, within Part 6 on the rights of third parties. It lets a non-debtor who owns the seized property, or who is a qualifying co-owner or a person entitled to prior registration, apply to the writ-issuing court to release the property. The core deadline is sixty days from seizure, extendable only for special circumstances and not later than seven days before the first auction, with a narrow force majeure exception; special deadlines apply to Section 332 property, where the net sale proceeds stand in for the property. On acceptance the auction is stayed and the court tries ownership as an ordinary case, while later paragraphs let a creditor demand security against, and later claim damages for, a baseless delaying application. Its scope and sixty-day rule were reshaped by the Civil Procedure Code Amendment Act (No. 30) B.E. 2560 (2017), which the Supreme Court has applied to seizures decided after 5 September 2017.
Why this matters in practice
If the officer has seized property that is really yours, this is your route, but the clock is unforgiving: file with the writ-issuing court within sixty days of the seizure. Extensions exist only for special circumstances, and never later than seven days before the first auction, so missing the window can cost you the asset. Be ready too for the creditor to argue your claim is a delaying tactic, which can force you to post security. Because ownership is then tried like a full case, this is not a do-it-yourself step; speak to a lawyer experienced in execution disputes promptly.

A person claiming ownership may file a release application after the sixty-day period where special circumstances exist, provided the filing is not later than seven days before the date set for the first auction; the appellate court erred in refusing to find special circumstances on those facts.
The claimant filed to release the seized property after the sixty-day period. The Supreme Court held that, because the filing was not later than seven days before the first auction, the claimant was entitled to file under Section 323 paragraph one, and the Court of Appeal Region 5 was wrong to find no special circumstances.

Where property was seized before the amended Section 323 came into force on 5 September 2560 but the application to release it is filed afterwards, the amended provision governs. The sixty-day period cannot be counted from a seizure that predates the amendment, so the applicant is treated as having special circumstances within paragraph one and may file after that period has passed.
The land and buildings were seized on 30 June 2558, before the amended Section 323 took effect on 5 September 2560, and the release application was filed on 27 June 2561, after it. The Supreme Court held the amended provision governed, but that it was impossible to file within sixty days of a seizure that predated it, and the applicant had also had to wait for an earlier release application to run its course until the Supreme Court refused the further appeal. Those were special circumstances within paragraph one, so the applicant had the right to bring this application.
