ในประมวลกฎหมายนี้ ถ้าข้อความมิได้แสดงให้เห็นเป็นอย่างอื่น
(๑) “ศาล” หมายความว่า ศาลยุติธรรมหรือผู้พิพากษาที่มีอำนาจพิจารณาพิพากษาคดีแพ่ง
(๒) “คดี” หมายความว่า กระบวนพิจารณานับตั้งแต่เสนอคำฟ้องต่อศาลเพื่อขอให้รับรอง คุ้มครองบังคับตามหรือเพื่อการใช้ซึ่งสิทธิหรือหน้าที่
(๓) “คำฟ้อง” หมายความว่า กระบวนพิจารณาใด ๆ ที่โจทก์ได้เสนอข้อหาต่อศาล ไม่ว่าจะได้เสนอด้วยวาจาหรือทำเป็นหนังสือ ไม่ว่าจะได้เสนอต่อศาลชั้นต้นหรือชั้นอุทธรณ์หรือฎีกา ไม่ว่าจะได้เสนอในขณะที่เริ่มคดีโดยคำฟ้องหรือคำร้องขอ หรือเสนอโดยภายหลังโดยคำฟ้องเพิ่มเติมหรือแก้ไข หรือฟ้องแย้งหรือโดยสอดเข้ามาในคดีไม่ว่าด้วยสมัครใจ หรือถูกบังคับ หรือโดยมีคำขอให้พิจารณาใหม่

(๖) “คำแถลงการณ์” หมายความว่า คำแถลงด้วยวาจาหรือเป็นหนังสือ ซึ่งคู่ความฝ่ายหนึ่งกระทำหรือยื่นต่อศาล ด้วยมุ่งหมายที่จะเสนอความเห็นต่อศาลในข้อความในประเด็นที่ได้ยกขึ้นอ้างในคำคู่ความหรือในปัญหาข้อใดที่ศาลจะพึงมีคำสั่งหรือคำพิพากษา ซึ่งในข้อเหล่านี้คู่ความฝ่ายนั้นเพียงแต่แสดง หรือกล่าวทบทวนหรือยืนยันหรืออธิบายข้อความแห่งคำพยานหลักฐาน และปัญหาข้อกฎหมายและข้อเท็จจริงทั้งปวง คำแถลงการณ์อาจรวมอยู่ในคำ คู่ความ

(๘) “การพิจารณา” หมายความว่า กระบวนพิจารณาทั้งหมดในศาลใดศาลหนึ่ง ก่อนศาลนั้นชี้ขาดตัดสินหรือจำหน่ายคดีโดยคำพิพากษาหรือคำสั่ง
(๙) “การนั่งพิจารณา” หมายความว่า การที่ศาลออกนั่งเกี่ยวกับการพิจารณาคดี เช่น ชี้สองสถาน สืบพยาน ทำการไต่สวน ฟังคำขอต่าง ๆ และฟังคำแถลงการณ์ด้วยวาจา
(๑๐) “วันสืบพยาน” หมายความว่า วันที่ศาลเริ่มต้นทำการสืบพยาน
(๑๑) “คู่ความ” หมายความว่า บุคคลผู้ยื่นคำฟ้องหรือถูกฟ้องต่อศาล และเพื่อประโยชน์แห่งการดำเนินกระบวนพิจารณาให้รวมถึงบุคคลผู้มีสิทธิกระทำการแทนบุคคลนั้น ๆ ตามกฎหมาย หรือในฐานะทนายความ
(๑๒) “บุคคลผู้ไร้ความสามารถ” หมายความว่า บุคคลใด ๆ ซึ่งไม่มีความสามารถตามกฎหมายหรือความสามารถถูกจำกัดโดยบทบัญญัติแห่งประมวลกฎหมายแพ่งและพาณิชย์ว่าด้วยความสามารถ
(๑๓) “ผู้แทนโดยชอบธรรม” หมายความว่า บุคคลซึ่งตามกฎหมายมีสิทธิที่จะทำการแทนบุคคลผู้ไร้ความสามารถหรือเป็นบุคคลที่จะต้องให้คำอนุญาต หรือให้ความยินยอมแก่ผู้ไร้ความสามารถในอันที่จะกระทำการอย่างใดอย่างหนึ่ง
(๑๔) เจ้าพนักงานบังคับคดี หมายความว่า เจ้าพนักงานในสังกัดกรมบังคับคดีหรือพนักงานอื่นผู้มีอำนาจตามบทบัญญัติแห่งกฎหมายที่ใช้อยู่ ในอันที่จะปฏิบัติตามวิธีการที่บัญญัติไว้ในภาค ๔ แห่งประมวลกฎหมายนี้ เพื่อคุ้มครองสิทธิของคู่ความในระหว่างการพิจารณา หรือเพื่อบังคับตามคำพิพากษาหรือคำสั่ง และให้หมายความรวมถึงบุคคลที่ได้รับมอบหมายจากเจ้าพนักงานบังคับคดีให้ปฏิบัติการแทน
English translation
In this Code, unless the context requires otherwise:
(1) "Court" means a Court of Justice or a judge having the power to try and adjudicate civil cases.
(2) "Case" means the proceedings from the moment a plaint is submitted to the court in order to have a right or duty recognized, protected, enforced, or exercised.
(3) "Plaint" means any proceeding by which the plaintiff submits a charge to the court, whether submitted orally or in writing, whether submitted to the court of first instance, the appellate court, or the Supreme Court, whether submitted at the commencement of a case by way of a plaint or a petition, or submitted afterwards by way of an additional or amended plaint, a counterclaim, or by intervention in the case, whether voluntary or compelled, or by a request for a new trial.
(4) "Answer" means any proceeding by which one party raises a defense in reply to the plaint as provided in this Code, other than a statement of argument.
(5) "Pleading" means all plaints, answers, or motions submitted to the court to establish the issues between the parties.
(6) "Statement of argument" means an argument, oral or in writing, made or submitted to the court by a party with the aim of presenting its opinion to the court on matters in issue raised in the pleadings, or on any question on which the court is to make an order or judgment, in which the party merely shows, restates, confirms, or explains the substance of the evidence and all questions of law and fact. A statement of argument may be included in a pleading.
(7) "Proceeding" means any act provided for in this Code relating to a case, done by a party to the case, or by the court, or by order of the court, whether done by a party to the court or to the other party, or by the court to any one party or to all parties, and includes the service of pleadings and other documents as provided in this Code.
(8) "Trial" means all proceedings in a given court before that court decides or disposes of the case by judgment or order.
(9) "Sitting for trial" means the court sitting in connection with the trial of a case, such as settlement of issues, examination of witnesses, conduct of an inquiry, hearing of the various motions, and hearing of oral statements of argument.
(10) "Date for taking evidence" means the date on which the court begins to take evidence.
(11) "Party" means a person who submits a plaint or who is sued before the court, and, for the purpose of conducting the proceedings, includes a person who has the right by law to act on behalf of such person, or in the capacity of an attorney.
(12) "Person under incapacity" means any person who lacks legal capacity, or whose capacity is limited, under the provisions of the Civil and Commercial Code on capacity.
(13) "Statutory representative" means a person who by law has the right to act on behalf of a person under incapacity, or who is the person that must give permission or consent to a person under incapacity to do any act.
(14) "Execution officer" means an officer attached to the Legal Execution Department, or another officer having power under the provisions of law in force, to carry out the methods provided in Book 4 of this Code in order to protect the rights of the parties during the trial, or to enforce a judgment or order, and includes a person assigned by an execution officer to act in their place.

This is the definitions section that opens the Code, in Title 1. It supplies the controlled vocabulary that every later provision relies on, so terms such as plaint, pleading, and party are fixed here rather than left to ordinary usage. The distinctions matter in practice: whether a document is a plaint or merely a motion, or whether a filing is a pleading that frames the issues, can decide questions such as duplicate suits, the right to raise a point on appeal, and who counts as a party. The definition of execution officer in (14) governs the enforcement provisions in Book 4.
Why this matters in practice
For anyone in litigation these labels are not academic. Whether your filing is treated as a plaint, a counterclaim, or a motion affects court fees, deadlines, and whether it can be barred as a duplicate suit. It also determines who is a party entitled to notice and to conduct the case, including through an attorney. A statement in reply to an appeal is a pleading within the meaning of Section 1(5), so a party who files one may set issues in it for the appellate court to decide, even without filing its own appeal.
The objecting party had not appealed, because the first court dismissed the petition, but filed a reply to the appeal arguing that the petitioners lacked standing. The court held that a reply to an appeal is a pleading under Section 1(5), so the standing issue remained live on appeal and did not become final with the first court's judgment.

A motion to bring an outsider into the case as a co-defendant for indemnity or contribution under Section 57(3) is not a plaint within the meaning of Section 1(3), because the applicant does not ask the court to order that person to pay the applicant.
The defendant moved to summon two outsiders as co-defendants so they would share liability to the plaintiff. The court held this was not a plaint under Section 1(3), because the defendant sought no payment from them, so the motion could not be a duplicate suit against them.

Where a judgment creditor, a judgment debtor or an interested third party is harmed because the execution officer has carried out the execution defectively, mistakenly or unlawfully, section 295 paragraph two is the provision enacted specifically for that situation: the person applies to the court to set aside or correct the execution, or to direct the officer as the court thinks fit. The application goes to the court in the original case or the court that issued the writ, under section 7(2) with section 271. A fresh action asking the court to set aside the auction is not available, even where the new claim also raises the cancellation of the title deed. Section 1(14), which defines the execution officer, does separate work: the execution officer is an official who merely carries out execution under the judgment or order, and cannot be an interested party or a party to the case, so there is no standing to sue him.
The plaintiff brought a fresh action to have an execution auction of the disputed land set aside, saying the first defendant was not the true owner and the title deed had been issued unlawfully, and joined the execution officer as the fifth defendant. The Supreme Court held that section 295 paragraph two is the provision specifically enacted for challenges to defective execution, and that such a challenge must be made by application to the court in the original case or the court that issued the writ under section 7(2) with section 271; a new action was therefore not open to the plaintiff, notwithstanding that the claim also sought cancellation of the title deed. As to the execution officer, he is an official whose function is only to carry out execution under the judgment or order and who cannot become an interested party or a party, so the plaintiff had no standing to sue the fifth defendant.
