Article 18: Court screening of pleadings

ให้ศาลมีอำนาจที่จะตรวจคำคู่ความที่พนักงานเจ้าหน้าที่ของศาลได้รับไว้เพื่อยื่นต่อศาล หรือส่งให้แก่คู่ความ หรือบุคคลใด ๆถ้าศาลเห็นว่าคำคู่ความที่ได้ยื่นไว้ดังกล่าวแล้วนั้น อ่านไม่ออก หรืออ่านไม่เข้าใจ หรือเขียนฟุ่มเฟือยเกินไป หรือไม่มีรายการ ไม่มีลายมือชื่อ ไม่แนบเอกสารต่าง ๆ ตามที่กฎหมายต้องการ หรือมิได้ชำระหรือวางค่าธรรมเนียมศาลโดยถูกต้องครบถ้วน ศาลจะมีคำสั่งให้คืนคำคู่ความนั้นไปให้ทำมาใหม่ หรือแก้ไขเพิ่มเติม หรือชำระหรือวางค่าธรรมเนียมศาลให้ถูกต้องครบถ้วน ภายในระยะเวลาและกำหนดเงื่อนไขใด ๆ ตลอดจนเรื่องค่าฤชาธรรมเนียมตามที่ศาลเห็นสมควรก็ได้ ถ้ามิได้ปฏิบัติตามข้อกำหนดของศาลในระยะเวลาหรือเงื่อนไขที่กำหนดไว้ก็ให้มีคำสั่งไม่รับคำคู่ความนั้น ถ้าศาลเห็นว่าคำคู่ความที่ได้นำมายื่นดังกล่าวข้างต้น มิได้เป็นไปตามเงื่อนไขแห่งกฎหมายที่บังคับไว้ นอกจากที่กล่าวมาในวรรคก่อน และโดยเฉพาะอย่างยิ่ง เมื่อเห็นว่าสิทธิของคู่ความหรือบุคคลซึ่งยื่นคำคู่ความนั้นได้ถูกจำกัดห้ามโดยบทบัญญัติแห่งกฎหมายเรื่องเขตอำนาจศาล ก็ให้ศาลมีคำสั่งไม่รับหรือคืนคำคู่ความนั้นไปเพื่อยื่นต่อศาลที่มีเขตอำนาจถ้าไม่มีข้อขัดข้องดังกล่าวแล้ว ก็ให้ศาลจดแจ้งแสดงการรับคำคู่ความนั้นไว้บนคำคู่ความนั้นเองหรือในที่อื่นคำสั่งของศาลที่ไม่รับหรือให้คืนคำคู่ความตามมาตรานี้ ให้อุทธรณ์และฎีกาได้ตามที่บัญญัติไว้ในมาตรา ๒๒๗, ๒๒๘ และ ๒๔๗

English translation

The court shall have the power to examine pleadings that the court officials have received for filing with the court, or for service on a party or any person.
If the court is of the opinion that a pleading so filed is illegible, or unintelligible, or written with excessive verbosity, or lacks particulars, lacks a signature, does not have attached the various documents required by law, or that the court fee has not been paid or deposited correctly and in full, the court may order that the pleading be returned to be redone, or amended or supplemented, or that the court fee be paid or deposited correctly and in full, within such time and on such conditions, including as to costs, as the court thinks fit. If there is a failure to comply with the court's requirement within the time or on the conditions fixed, the court shall order that the pleading not be accepted.
If the court is of the opinion that a pleading so submitted does not comply with the conditions imposed by law, apart from those mentioned in the preceding paragraph, and in particular when it appears that the right of the party or person submitting the pleading is restricted or prohibited by the provisions of law on the jurisdiction of the courts, the court shall order that the pleading not be accepted, or shall return it for submission to the court having jurisdiction.
If there is no such impediment, the court shall record its acceptance of the pleading on the pleading itself or elsewhere.
A court order not accepting or returning a pleading under this section may be appealed and further appealed as provided in sections 227, 228 and 247.

Section 18 gives the court a gatekeeping power over pleadings within Chapter 3. The second paragraph deals with formal defects, illegibility, verbosity, missing particulars, signature, or documents, or unpaid fees, which the court may allow to be cured within a fixed time, failing which the pleading is not accepted. The third paragraph deals with substantive legal bars, especially want of jurisdiction, allowing the court to refuse the pleading or return it to the proper court. Acceptance is recorded under the fourth paragraph. Importantly, the final paragraph preserves the right to appeal an order not accepting or returning a pleading under Sections 227, 228 and 247, so a party is not left without recourse against a screening decision. The power is widely applied through other procedural statutes that incorporate the Code.

Why this matters in practice

Most pleadings that get bounced at the counter are bounced under this section, usually for a missing signature or document, an unpaid or short-paid fee, or the wrong court. Fix the defect within the time the court fixes, because missing that deadline turns a curable problem into a refusal. If your pleading is refused or returned, you can appeal under Sections 227, 228 and 247. Getting the filing right the first time saves fees and time; if you are unsure which court has jurisdiction or what must be attached, take advice from a Thai lawyer before filing.

  1. Arrêt de la Cour suprême n° 1088/2566 (2023)

    A court may dismiss a petition at the screening stage under Section 18, without first making an order accepting it, where examination shows it should not proceed.

    The Central Bankruptcy Court, on examining the petitioners' business rehabilitation petition, dismissed it. The Supreme Court held the court had power to dismiss the petition at the examination stage under Section 18, applied with the third paragraph of Section 172 and the Bankruptcy Court Act, without needing to accept the petition first.

  2. Arrêt de la Cour suprême n° 3116/2567 (2024)

    A grievance or appeal procedure laid down by ministerial regulation, which gives an employee the option of complaining to an internal committee, is not a mandatory step to be completed before suing in the Labour Court. Failure to use it therefore cannot be relied on under section 18 paragraph three to deprive the plaintiff of standing.

    The Ministerial Regulation on the protection of work and remuneration of staff in private higher education institutions B.E. 2549 gives staff the option of appealing or complaining to the institution's protection committee; it does not require them to do so in every case, nor before suing in the Labour Court. It could not therefore be used to cut off the plaintiff's claim for severance pay and pay in lieu of notice, and no law required any prior step for the claims for breach of the employment contract or unfair dismissal. The regulation does require a staff member who chooses one route to pursue it to the end, and by suing on 17 December 2563 the plaintiff had chosen the court and waived the internal appeal, so his later appeal to the committee did not remove the standing he already had.

  3. Arrêt de la Cour suprême n° 3748/2565 (2022)

    An order revoking the acceptance of a petition because the court fee was short-paid, and permitting a fresh petition to be filed, is not an order refusing or returning a pleading under the last paragraph of section 18 from which an appeal lies under section 228. It is an interlocutory order, and an appeal against it is barred by section 226(1) unless an objection has first been recorded.

    Although the applicant's motion asked that his own portion of the land be set aside before the auction, in substance it sought the release of the part he possessed as his own, which is a third-party claim under section 323 paragraph one and therefore a plaint under section 1(3). Filing it put the third-party claim before the court without any need for the court to accept it first. The trial court's order revoking its acceptance for a short-paid fee and permitting a fresh petition therefore left the original motion on foot; it was not an order refusing or returning a pleading under the last paragraph of section 18 from which an appeal lies, but an interlocutory order barred from appeal by section 226(1).
