ถ้าผู้รับจำนำเอาทรัพย์สินซึ่งจำนำออกใช้เอง หรือเอาไปให้บุคคลภายนอกใช้สอย หรือเก็บรักษาโดยผู้จำนำมิได้ยินยอมด้วยไซร้ ท่านว่าผู้รับจำนำจะต้องรับผิดเพื่อที่ทรัพย์สินจำนำนั้นสูญหาย หรือบุบสลายไปอย่างใด ๆ แม้ทั้งเป็นเพราะเหตุสุดวิสัย เว้นแต่จะพิสูจน์ได้ว่าถึงอย่างไร ๆ ก็คงจะต้องสูญหาย หรือบุบสลายอยู่นั่นเอง

If, without the consent of the pledgor, the pledgee usues the pledged property or lets a third person have custody over it, he is liable for any loss or damage to the pledged property, even caused by force majeure, unless he proves that the loss or damage would have happened in any case.

Lawyers: This provision imposes near-absolute liability on a pledgee who uses pledged property without consent. The only defence is proving inevitable loss regardless of the unauthorised use.
