English translation

If, without the consent of the pledgor, the pledgee uses the pledged property, or lets a third person use it or have custody of it, he is liable for any loss of or damage to the pledged property, even if caused by force majeure, unless he proves that the loss or damage would have happened in any case.

Notable

Why this matters in practice

Lawyers: This provision imposes near-absolute liability on a pledgee who uses pledged property without consent. The only defence is proving inevitable loss regardless of the unauthorised use. This rule deters misuse of pledged assets by lenders. Laypeople: If you pledge an item to a lender and the lender uses it without your permission, the lender is responsible if it is damaged or lost: even if the cause was accidental.

Legislative history

Part of the original Civil and Commercial Code codification; no major subsequent amendment.
