ผู้ใดกระทำความผิดด้วยความจำเป็น
(๑) เพราะอยู่ในที่บังคับ หรือภายใต้อำนาจซึ่งไม่สามารถหลีกเลี่ยงหรือขัดขืนได้ หรือ
(๒) เพราะเพื่อให้ตนเองหรือผู้อื่นพ้นจากภยันตรายที่ใกล้จะถึง และไม่สามารถหลีกเลี่ยงให้พ้นโดยวิธีอื่นใดได้ เมื่อภยันตรายนั้นตนมิได้ก่อให้เกิดขึ้นเพราะความผิดของตน
ผู้นั้นไม่ต้องรับโทษ
ความผิดฐานนี้ การกระทำนั้นต้องไม่เกินสมควรแก่เหตุ ถ้าเกินสมควรแก่เหตุ ศาลจะลงโทษน้อยกว่าที่กฎหมายกำหนดไว้สำหรับความผิดนั้นเพียงใดก็ได้

Whoever commits an offence out of necessity:
(1) Because of being under compulsion or under a power which cannot be avoided or resisted; or
(2) Because of the need to save oneself or another person from an imminent danger which cannot be averted by other means, provided that such danger was not caused by the fault of the offender;
Shall not be punished.
The act done must not be beyond what is reasonable under the circumstances. If it is beyond what is reasonable, the Court may impose a punishment less than that provided by law for such offence to any extent.
