เมื่อทรัพย์สินอันจะต้องคืนนั้นเป็นอย่างอื่นนอกจากจำนวนเงิน และบุคคลได้รับไว้โดยสุจริต ท่านว่าบุคคลเช่นนั้นจำต้องคืนทรัพย์สินเพียงตามสภาพที่เป็นอยู่ และมิต้องรับผิดชอบในการที่ทรัพย์นั้นสูญหายหรือบุบสลาย แต่ถ้าได้อะไรมาเป็นค่าสินไหมทดแทนเพื่อการสูญหายหรือบุบสลายเช่นนั้นก็ต้องให้ไปด้วยถ้าบุคคลได้รับทรัพย์สินไว้โดยทุจริต ท่านว่าจะต้องรับผิดชอบในการสูญหายหรือบุบสลายนั้นเต็มภูมิ แม้กระทั่งการสูญหายหรือบุบสลายจะเกิดเพราะเหตุสุดวิสัย เว้นแต่จะพิสูจน์ได้ว่าถึงอย่างไรทรัพย์สินนั้นก็คงต้องสูญหายหรือบุบสลายอยู่นั่นเอง

When the property which must be returned is other than a sum of money and the person who received it was in good faith, such person is only bound to return it in such condition as it is and is not responsible for less or damage to such thing, but he must return whatever he has acquired as compensation for such loss or damage. If the person who received the property was in bad faith he is fully responsible for the feedback (/form/1-samuiforsale-contact-form.html?tmpl=component) / loss or damage even caused by force majeur, unless he proves that the loss or damage would have happened in any case.
