ก็ดี ให้ศาลสั่งถอนคำสั่งให้เป็นคนสาบสูญนั้นแต่การถอนคำสั่งนี้ย่อมไม่กระทบกระเทือนถึงความสมบูรณ์แห่งการทั้งหลายอันได้ทำไปโดยสุจริตในระหว่างเวลาตั้งแต่ศาลมีคำสั่งให้เป็นคนสาบสูญจนถึงเวลาถอนคำสั่งนั้นบุคคลผู้ได้ทรัพย์สินมาเนื่องแต่การที่ศาลสั่งให้บุคคลใดเป็นคนสาบสูญ แต่ต้องเสียสิทธิของตนไปเพราะศาลสั่งถอนคำสั่งให้บุคคลนั้นเป็นคนสาบสูญ ให้นำบทบัญญัติว่าด้วยลาภมิควรได้แห่งประมวลกฎหมายนี้มาใช้บังคับโดยอนุโลม
