และตามบทบัญญัติแห่งมาตรานี้ถ้าบุคคลซึ่งมีหน้าที่ที่จะต้องจัดตั้งมูลนิธิตามวรรคหนึ่ง มิได้ขอจดทะเบียนก่อตั้งมูลนิธิภายในหนึ่งร้อยยี่สิบวันนับแต่วันที่บุคคลดังกล่าวได้รู้หรือควรรู้ข้อกำหนดพินัยกรรมให้ก่อตั้งมูลนิธิ บุคคลผู้มีส่วนได้เสียคนหนึ่งคนใดหรือพนักงานอัยการจะเป็นผู้ขอจดทะเบียนมูลนิธิก็ได้ ถ้าผู้ยื่นคำขอจดทะเบียนมูลนิธิไม่ดำเนินการแก้ไขหรือเปลี่ยนแปลงให้ถูกต้องตามคำสั่งของนายทะเบียนตาม

The application for registration of a foundation must be filed in writing with the Registrar of the area where the principal office of the foundation is situated, and it must at least specify the owner of the property and the list of the property appropriated for the feedback (/form/1-samuiforsale-contact-form.html?tmpl=component) / foundation together with the list of names, addresses and occupation of all the would-be directors of the foundation, including the regulations of the foundation.
