ถ้าทรัพย์สินซึ่งให้นั้นมีค่าภาระติดพัน และผู้รับละเลยเสียไม่ชำระค่าภาระติดพันนั้นไซร้ ท่านว่าโดยเงื่อนไขอันระบุไว้ในกรณีสิทธิเลิกสัญญาต่างตอบแทนกันนั้น ผู้ให้จะเรียกให้ส่งทรัพย์สินที่ให้นั้นคืนตามบทบัญญัติว่าด้วยคืนลาภมิควรได้นั้นก็ได้ เพียงเท่าที่ควรจะเอาทรัพย์นั้นไปใช้ชำระค่าภาระติดพันนั้นแต่สิทธิเรียกคืนอันนี้ย่อมเป็นอันขาดไป ถ้าบุคคลภายนอกเป็นผู้มีสิทธิจะเรียกให้ชำระค่าภาระติดพันนั้น

If the gift is encumbered with a charge and the donee fails to perform the charge, the donor may, under the conditions specified for the right of rescission in the case of reciprocal contracts, demand the return of the gift under the provisions relating to the return of undue enrichment in so far as the gift ought to have been applied to the performance of the change. This claim is barred if a third party is entitled to require the performance of the charge.
