Si le don est grevé d'une charge et que le donataire manque à son obligation, le donateur peut, dans les conditions prévues pour le droit de résolution des contrats réciproques, exiger la restitution du don au titre de la restitution de l'enrichissement sans cause, pour la part du don qui aurait dû être affectée à l'exécution de l'obligation. Cette demande est irrecevable si un tiers est en droit d'exiger l'exécution de la charge.
