แล้วแต่กรณี มาตรา ๑๔๔๖[135] คู่หมั้นฝ่ายหนึ่งอาจเรียกค่าทดแทนจากผู้ซึ่งได้ข่มขืนกระทำชำเราหรือพยายามข่มขืนกระทำชำเราคู่หมั้นของตนโดยรู้หรือควรจะรู้ถึงการหมั้นนั้นได้โดยไม่จำต้องบอกเลิกสัญญาหมั้นมาตรา ๑๔๔๗[136] ค่าทดแทนอันจะพึงชดใช้แก่กันตามหมวดนี้ให้ศาลวินิจฉัยตามควรแก่พฤติการณ์ สิทธิเรียกร้องค่าทดแทนตามหมวดนี้ นอกจากค่าทดแทนตาม
