ในกรณีมีเหตุสำคัญอันเกิดแก่ผู้หมั้น ทำให้ผู้รับหมั้นไม่สมควรสมรสกับผู้หมั้นนั้น ผู้รับหมั้นมีสิทธิบอกเลิกสัญญาหมั้นได้โดยมิต้องคืนของหมั้นแก่ผู้หมั้น
