Notable

Why this matters in practice

For lawyers: this section has no direct operational effect; it is a commencement provision. Its importance is historical — it confirms when Book 6 rules began to apply and which transitional provisions governed successions opened before 1 October 1935. For clients: Book 6 has governed all successions in Thailand since 1935 and remains in force today.

Legislative history

Book 6 of the Civil and Commercial Code came into force on 1 October B.E. 2478 (1935). It was enacted alongside the Civil and Commercial Code Amendment Act B.E. 2478. Prior to this codification, succession in Thailand was governed by a patchwork of pre-modern Siamese customary law and royal decrees. The Marriage Equality Act (No. 24, B.E. 2567), in force 22 January 2025, is the most significant recent development affecting Book 6 succession rules, by extending spousal inheritance rights to same-sex spouses.
