ในคดีคุกคามทางเพศ ถ้าความปรากฏแก่ศาลเองหรือตามข้อเสนอของพนักงานอัยการ โจทก์ ผู้เสียหาย หรือเจ้าพนักงานว่าจำเลยมีพฤติการณ์อันควรเชื่อได้ว่าจะคุกคามทางเพศหรือรบกวนการดำเนินชีวิตตามปกติของผู้เสียหายอย่างต่อเนื่อง ไม่ว่าศาลจะลงโทษจำเลยหรือไม่ก็ตาม ศาลอาจสั่งห้ามจำเลยนั้นกระทำการอย่างหนึ่งอย่างใดตามเงื่อนไขและภายในระยะเวลาที่ศาลกำหนด แต่ไม่เกินสองปี

English translation

In a case of sexual harassment, if it appears to the court itself, or on the proposal of the public prosecutor, the plaintiff, the injured person or an official, that the defendant has behaved in a manner giving reason to believe that the defendant will sexually harass the injured person or continuously disturb that person's normal life, the court may, whether or not it imposes a punishment on the defendant, order the defendant not to do any specified act, on such conditions and for such period as the court fixes, but not exceeding two years.

A defendant who contravenes an order of the court under paragraph one shall be liable to imprisonment not exceeding six months, or a fine not exceeding ten thousand baht, or both.

Section 284/3 is a protective measure attached to the sexual-harassment offences in Sections 284/1 and 284/2, not a separate offence. In a sexual-harassment case, where it appears to the court on its own view or on the proposal of the public prosecutor, the plaintiff, the injured person or an official that the defendant has behaved in a manner giving reason to believe that he will sexually harass the injured person or continuously disturb that person's normal life, the court may prohibit the defendant from doing any specified act, on such conditions and for such period as the court fixes, up to a maximum of two years. The power does not depend on conviction: the section applies whether or not the court punishes the defendant, so an acquittal or a decision not to impose punishment does not remove it. Breach of the order is itself punishable, by imprisonment not exceeding six months or a fine not exceeding ten thousand baht, or both. Section 284/4 supplies the separate power to order harassing data removed from a computer system.

Why this matters in practice

The point most often missed is that a Section 284/3 order does not wait for a conviction. The court can impose it whether or not it punishes the defendant, so a complainant should ask for it early rather than treat it as a sentencing add-on, and a defendant should not assume that an acquittal ends the matter. The order can run for up to two years and its terms are whatever the court fixes, so the scope of the prohibited acts is worth arguing about at the time it is made. Breach is a fresh offence carrying up to six months' imprisonment or a fine of up to 10,000 baht, or both, which means the practical exposure can outlast the penalty in the original case.
