พินัยกรรมซึ่งบุคคลผู้ถูกศาลสั่งให้เป็นคนไร้ความสามารถทำขึ้นนั้น เป็นโมฆะพินัยกรรมซึ่งบุคคลผู้ถูกอ้างว่าเป็นคนวิกลจริต แต่ศาลยังไม่ได้สั่งให้เป็นคนไร้ความสามารถทำขึ้นนั้น จะเป็นอันเสียเปล่าก็แต่เมื่อพิสูจน์ได้ว่าในเวลาที่ทำพินัยกรรมนั้นผู้ทำจริตวิกลอยู่

English translation
A will made by a person adjudged incompetent is void. A will made by a person, who is alleged to be of unsound mind but not adjudged incompetent, may be annulled only if it is proved that at the time of making the will the testator was actually of unsound mind.
