ผู้เขียน หรือพยานในพินัยกรรมจะเป็นผู้รับทรัพย์ตามพินัยกรรมนั้นไม่ได้ให้ใช้บทบัญญัติในวรรคก่อนบังคับแก่คู่สมรสของผู้เขียนหรือพยานในพินัยกรรมด้วยพนักงานเจ้าหน้าที่ซึ่งได้จดข้อความแห่งพินัยกรรมที่พยานนำมาแจ้งตาม
