เมื่อบุคคลใดนอกจากผู้ทำพินัยกรรมเป็นผู้เขียนข้อความแห่งพินัยกรรม บุคคลนั้นต้องลงลายมือชื่อของตนทั้งระบุว่าเป็นผู้เขียนถ้าบุคคลนั้นเป็นพยานด้วย ให้เขียนข้อความระบุว่าตนเป็นพยานไว้ต่อท้ายลายมือชื่อของตนเช่นเดียวกับพยานอื่น ๆ มาตรา ๑๖๗๒[280] ให้รัฐมนตรีว่าการกระทรวงมหาดไทย กลาโหม และต่างประเทศ มีอำนาจและหน้าที่เท่าที่เกี่ยวกับกระทรวงนั้น ๆ ที่จะออกกฎกระทรวง เพื่อให้การเป็นไปตามประมวลกฎหมายบรรพนี้ รวมทั้งกำหนดอัตราค่าฤชาธรรมเนียมอันเกี่ยวกับการนั้น

Where a person other than the testator is the writer of a will, such persons must sign his name thereon and add the statement that he is the writer. If such person is also a witness, a statement that he is a witness must be written down after his signature in the same manner as is done by any other witness.
