Non-Immigrant O Visa (Non-O): Family, Retirement and Guardian Purposes

เดอะ วีซ่าประเภท Non-Immigrant O (วีซ่าประเภทคนอยู่ชั่วคราว, usually shortened to Non-O หรือ non-immigrant O) is the category of Thai visa issued for reasons other than work, business or study: marriage to a Thai national, being the parent or child of a Thai, retirement at 50 or over, guardianship of a Thai child at school, and volunteer work. The visa itself is short, normally 90 days. Its real purpose is to serve as the platform for a one-year extension of stay granted inside Thailand, which is what people mean by a marriage visa or a retirement visa.

What the Non-O category covers and how it works

The letter O stands for other, a family of purposes rather than one visa. It is issued by a Thai embassy or consulate, since 1 January 2025 through the e-Visa portal, as a single entry valid for 90 days (about 2,000 baht) or a multiple entry valid for one year (about 5,000 baht). It can also be obtained inside Thailand by changing status from a visa exemption or tourist entry, provided at least 15 days of permitted stay remain and the qualifying documents are in hand.

Once the holder is in Thailand on a Non-O, immigration may grant an extension of stay of one year at a time on form TM7, fee 1,900 baht, under the Police Order that sets the conditions for each purpose. The extension, not the visa, carries the financial conditions: 400,000 baht in a Thai bank for two months or income of 40,000 baht a month for a Thai spouse; 800,000 baht or 65,000 baht a month for retirement; proof of the child’s school enrolment for a guardian.

Practical points for the applicant

The Non-O based on marriage needs the Thai ใบทะเบียนสมรส (Kor Ror 3) and the spouse’s ID card and house book; a foreign marriage must first be registered in Thailand. Same-sex spouses qualify since the Marriage Equality Act took effect on 23 January 2025. The guardian route needs the child’s birth certificate and a letter from the school.

A Non-O holder must file the รายงาน 90 วัน and, before any trip abroad, buy a ใบอนุญาตกลับเข้าประเทศ (1,000 baht single, 3,800 baht multiple) or the extension is cancelled on departure. The Non-O does not allow employment on its own; a spouse or parent of a Thai can obtain a ใบอนุญาตทำงาน while on it. The common mistake is to arrive on a tourist entry with the money in a foreign account: the seasoning period only starts once the funds sit in a Thai bank.

Non-O compared with Non-O-A, Non-O-X and Non-B

เดอะ Non-O-A is a one-year retirement visa issued abroad with a health-insurance condition of 3,000,000 baht or 100,000 US dollars, and the Non-O-X is a ten-year retirement visa for nationals of a short list of countries with 3,000,000 baht on deposit. The plain Non-O extension for retirement carries no insurance condition.

เดอะ ไม่ใช่บี is the equivalent platform for employment. A foreigner married to a Thai who also works can choose either; only the marriage extension survives a change of employer.

How long is a Non-O visa valid in Thailand?

A single-entry Non-O gives a stay of 90 days from the date of entry, and a multiple-entry Non-O is valid for one year with 90 days on each entry. The one-year stay that most holders enjoy is not the visa but an extension of stay granted by immigration inside Thailand, renewable each year on form TM7 for 1,900 baht.

Can I work on a Non-O visa in Thailand?

Not on the visa alone. A foreigner married to a Thai, or the parent of a Thai child, can apply for a work permit while holding a Non-O extension, and this route avoids the four-Thai-employees ratio that applies to a Non-B. Working without the permit remains an offence whatever the visa.

Can I change a tourist visa or visa exemption to a Non-O inside Thailand?

Yes, at the immigration office, if at least 15 days of the current permitted stay remain and the qualifying documents are ready, for example the Thai marriage certificate or the bank letter showing 800,000 baht. The change of status gives 90 days, after which the one-year extension is applied for.
