If a person who was instigated under Section 84, or a person who acted in response to an advertisement or an announcement to the general public to commit an offence under Section 85, gives important information disclosing the commission of the offence by the instigator, or by the person who advertised or announced to the general public that an offence be committed, and that information is of great benefit to the prosecution of such a person, the court may impose on the informant a punishment less than the minimum penalty prescribed for that offence, to any extent.

The reduction is discretionary and is not available merely for a guilty plea or for general cooperation; the information must actually expose the instigator and must be of real use to the prosecution of that person, so the value of what is offered should be established early with the investigating officer and the prosecutor. Because the court may go below the statutory minimum without limit, the difference this makes in an offence carrying a high floor can be greater than any other mitigation available.
