ผู้จัดการมรดกไม่ต้องส่งมอบทรัพย์มรดกหรือส่วนใดส่วนหนึ่งแห่งทรัพย์มรดกให้แก่ทายาทก่อนปีหนึ่งนับแต่วันที่เจ้ามรดกถึงแก่ความตาย เว้นแต่เจ้าหนี้กองมรดกและผู้รับพินัยกรรมที่ปรากฏตัวได้รับชำระหนี้และส่วนได้ตามพินัยกรรมแล้วทุกคน
