ถ้าลูกหนี้ขอปฏิบัติการชำระหนี้ และเจ้าหนี้ไม่รับชำระหนี้นั้นโดยปราศจากมูลเหตุอันจะอ้างกฎหมายได้ไซร้ ท่านว่าเจ้าหนี้ตกเป็นผู้ผิดนัด
