สิทธิถอนทรัพย์นั้น ตามกฎหมาย ศาลจะสั่งยึดหาได้ไม่เมื่อได้ฟ้องคดีล้มละลายเกี่ยวกับทรัพย์สินของลูกหนี้แล้ว ท่านห้ามมิให้ใช้สิทธิถอนทรัพย์ในระหว่างพิจารณาคดีล้มละลาย
