ถ้าลูกหนี้โต้แย้งการริบเบี้ยปรับโดยอ้างเหตุว่าตนได้ชำระหนี้แล้วไซร้ ท่านว่าลูกหนี้จะต้องพิสูจน์การชำระหนี้ เว้นแต่การชำระหนี้อันตนจะต้องทำนั้นเป็นการให้งดเว้นการอันใดอันหนึ่ง
