เมื่อผู้มีส่วนได้เสียหรือพนักงานอัยการร้องขอ หรือเมื่อศาลเห็นสมควร ศาลอาจสั่งอย่างหนึ่งอย่างใดดังต่อไปนี้(๑) ให้ผู้จัดการทรัพย์สินหาประกันอันสมควรในการจัดการทรัพย์สินของผู้ไม่อยู่ตลอดจนการมอบคืนทรัพย์สินนั้น (๒) ให้ผู้จัดการทรัพย์สินแถลงถึงความเป็นอยู่แห่งทรัพย์สินของผู้ไม่อยู่ (๓) ถอดถอนผู้จัดการทรัพย์สิน และตั้งผู้อื่นให้เป็นผู้จัดการทรัพย์สินแทนต่อไป
