เมื่อเจ้าหนี้ทั้งหลายได้สนองรับคำเสนอทั่วทุกคนแล้ว โดยแสดงออกชัดหรือโดยปริยายก็ดี ท่านว่าจำนองหรือบุริมสิทธิก็เป็นอันไถ่ถอนได้ด้วยผู้รับโอนใช้เงินหรือวางเงินตามจำนวนที่เสนอจะใช้แทนการชำระหนี้
