อันการพนันหรือขันต่อนั้น ท่านว่าหาก่อให้เกิดหนี้ไม่ สิ่งที่ได้ให้กันไปในการพนันหรือขันต่อก็จะทวงคืนไม่ได้ เพราะเหตุหามูลหนี้อย่างหนึ่งอย่างใดมิได้ข้อบัญญัติที่กล่าวนี้ ท่านให้ใช้ตลอดถึงข้อตกลงเป็นมูลหนี้อย่างหนึ่งอย่างใดอันฝ่ายข้างเสียพนันขันต่อหากทำให้แก่อีกฝ่ายหนึ่งเพื่อจะใช้หนี้เงินพนันหรือขันต่อนั้นด้วย

No obligation is created by gambling or betting. What has been given by reason of the gambling or betting may not be demanded back on the ground that no obligation existed. These provisions apply also to an agreement whereby the losing party, for the purpose of satisfying a gambling debt or a bet, incurs an obligation towards the other party.
