เจ้าของที่ดินริมทางน้ำ หรือมีทางน้ำผ่าน ไม่มีสิทธิจะชักเอาน้ำไว้เกินกว่าที่จำเป็นแก่ประโยชน์ของตนตามควร ให้เป็นเหตุเสื่อมเสียแก่ที่ดินแปลงอื่นซึ่งอยู่ตามทางน้ำนั้น
