สิทธิและหน้าที่ใด ๆ อันเกิดขึ้นตามพินัยกรรม ให้มีผลบังคับเรียกร้องกันได้ตั้งแต่ผู้ทำพินัยกรรมตายเป็นต้นไป เว้นแต่ผู้ทำพินัยกรรมจะได้กำหนดเงื่อนไขหรือเงื่อนเวลาให้มีผลบังคับเรียกร้องกันได้ภายหลัง
