หนี้ใดซึ่งตามมูลแห่งหนี้นั้น เจ้าหนี้จะได้รับชำระหนี้เป็นคราว ๆ เจ้าหนี้มีสิทธิเรียกให้ลูกหนี้ทำหนังสือรับสภาพหนี้ให้ในเวลาใดเวลาหนึ่งก่อนอายุความครบบริบูรณ์ เพื่อเป็นหลักฐานว่าอายุความสะดุดหยุดลง
