จำเลยมีข้อต่อสู้ลูกหนี้เดิมอยู่อย่างใด ๆ ท่านว่าจะยกขึ้นต่อสู้เจ้าหนี้ได้ทั้งนั้น เว้นแต่ข้อต่อสู้ซึ่งเกิดขึ้นเมื่อยื่นฟ้องแล้วส่วนที่ ๔เพิกถอนการฉ้อฉล
