Section 458 sets the default rule: title passes on contract formation. The major exception is §456 (immovables — title passes on registration). Other useful carve-outs: (1) parties may agree title transfers only on full payment (retention of title clause); (2) for unascertained or future goods, title transfers only when goods are identified to the contract.
